Student Proves The Power Of RTI Act By Getting Batla Post- Mortem ReportBy ugesh sarkar, Section News ![]() The final- year MA student of the AJK Mass Communication Research Centre at Jamia Millia Islamia has with singleminded devotion retrieved the elusive post- mortem report of Atif Ameen and Mohammed Sajid using the Right to Information ( RTI) Act. But it has been an arduous road for the young man. Alam said he had to file at least 10 RTI applications as he ran into one hurdle after another put up by the Delhi Police to keep the truth buried. It took him two years to get the report out using the RTI route -- normally, the turnaround time for an RTI application is 30 days. Alam, who is from Bihar's Champaran district, had filed the application on September 25, 2008, a week after the September 19 ` encounter', with the Delhi Police and the All- India Institute of Medical Sciences ( AIIMS), seeking the report. He also filed copies with the Supreme Court and the National Human Rights Commission ( NHRC), which had given a clean chit to the Delhi Police, amid allegations of a flawed investigation. The Delhi Police refused to respond to Alam's application, following which he filed his first appeal. He was refused the report under Section 154 of the Criminal Procedure Code. His application to AIIMS was also refused.
After the first and second appeal, the Central Information Commission ( CIC) issued an order that he be given the report. Bizarrely, however, the CIC issued a stay on the order within the next few days. Alam's first appeal to the NHRC, though, did deliver results. When the NHRC replied half- heartedly to his application, he pursued the matter further by asking the commission questions relating to the encounter. In response to these questions, the NHRC handed over copies of the post- mortem report and the FIR on Wednesday. Curiously, Alam had not set out to dispute the Delhi Police's version of the ` encounter'. In fact, he believed in it and had only wanted to demonstrate the power of the RTI Act. " I then believed that the encounter was the Delhi Police's biggest success till date in fighting terrorism. I just wanted to demonstrate to people that there was a peaceful way to register protests, instead of blocking the streets. I have nothing to do with the politics of the encounter," Alam said. He said he was happy that he had got his answers, even though it had taken a struggle of two years. What does he have to say now that the post- mortem report clearly blows holes into the special cell's version of events? " It confirms my faith in the RTI process. It may be arduous, but it always works," said Alam, who also conducts workshops in colleges on RTI. He will now have a personal case study to make his point to the students he wishes to turn into RTI warriors.
